Introduction
This Privacy Policy describes how the Telegram bot operated by magic-ai-video.st ("the Bot", "we", "us") handles information from users who interact with it via the Telegram platform.
By using the Bot, you accept the terms described in this policy. If you do not agree, you must stop using the Bot immediately.
We operate under the principles of minimal data collection, no permanent storage, and full transparency about how information is handled.
§ 02
Data We Collect
Due to the technical nature of the Telegram platform, the Bot automatically receives certain basic information from the platform environment:
- Telegram user ID: an anonymous numeric identifier assigned by Telegram. It does not contain your real name, phone number, or any personally identifying information.
- Chat type: whether the message originates from a private conversation or a group.
- Telegram client language (if available), to adapt responses accordingly.

We do not collect: name, surname, phone number, email address, IP address, geographic location, or any biometric data. The Telegram ID we receive is an opaque number — we cannot cross-reference it with any real-world identity on our end.

What We Do NOT Store
This is the most important section of our policy. We state clearly and without exception:

We do not store images, photos, videos, or multimedia files sent by the user to the Bot.

We do not store AI-generated images returned by the Bot to the user.

We do not store the user's conversation history.

We do not store text commands or instructions sent to the Bot.

We do not use user-provided content or generated outputs to retrain, fine-tune, or improve our AI models without explicit user consent.

We do not share any files, images, or user data with third parties, except the technical processors strictly necessary for the operation described in §04.
§ 04
Temporary File Processing
When you send an image to the Bot, it is transferred in encrypted form to our AI processing system solely for the time required to generate the result.

File lifecycle: The input image and the generated result exist in processing memory for seconds to minutes, depending on system load. Once the result is delivered to the user, both files are automatically and irreversibly deleted. No copy is retained.
This processing occurs on secure servers that do not keep logs of processed files. All transmission is performed under TLS encryption.
§ 05
Relationship with Telegram
This Bot operates on the Telegram platform, owned by Telegram Messenger Inc. Telegram has its own Privacy Policy that applies independently to messages and data transiting through its infrastructure.
We are an independent third party and have no access to Telegram's servers. Use of the Bot also implies acceptance of Telegram's Terms of Service.
Telegram assigns each user a unique ID that may reach our systems exclusively as a technical reference to manage the active conversation context. This data is not persisted once the session concludes.
§ 06
Protection of Minors

Absolute prohibition: This Bot is not directed at persons under 18 years of age, and it is strictly prohibited for minors to use it. If we detect or have reasonable grounds to suspect that a user is under 18, their access will be blocked immediately and permanently.
It is also absolutely prohibited to process images in which minors appear, regardless of the type of transformation requested. The system incorporates automatic detection mechanisms to block such content. Any attempt to process images of minors will result in immediate and permanent account suspension and may be reported to the relevant authorities.
§ 07
Security
We apply reasonable technical and organizational measures to protect data during processing, including encryption in transit, access controls, and automatic deletion of temporary files.
No system is 100% secure. While we take all reasonable precautions, we cannot guarantee absolute security against external attacks beyond our control.
§ 08
Your Rights
Since we do not store identifiable personal data, rights of access, rectification, and erasure (GDPR and equivalent legislation) have limited practical application. Nevertheless, you may contact us to:
- Request information about what minimal technical data we associate with your Telegram ID.
- Request deletion of any existing technical record associated with your ID.
- Exercise any other right recognised by the legislation applicable in your country.
We handle all requests within a maximum of 30 calendar days.
§ 09
Policy Changes
We reserve the right to update this Privacy Policy at any time. Changes will be communicated via the Bot itself and/or the official Telegram channel. Continued use of the Bot after changes are published constitutes acceptance of the new version.

Welcome to Magic AI Video
These Terms and Conditions (the "Agreement") govern the relationship between magic-ai-video.st ("Magic AI Video", "we", "us") and the user ("User", "you") regarding access to and use of the Telegram bot @magic_ai_video_bot (the "Bot") and the AI image generation services it provides (the "Services").
Acceptance. Simply using the Bot constitutes full acceptance of this Agreement. If you disagree with any of its terms, you must stop using the Bot immediately.
Modifications. We may modify this Agreement at any time. Changes will be published and communicated via the Bot. Continued use after publication constitutes acceptance of the updated terms.
§ 01
Service Description
a) What the Bot provides
The Bot allows users to submit photographic images and apply visual transformations to them using artificial intelligence algorithms, receiving as output new, synthetic, AI-generated images.
b) Access channel
The service is provided exclusively through the Telegram messaging platform. There is no standalone web version, independent mobile application, or associated public API unless expressly stated.
c) Geographic restrictions
The service is not available in certain jurisdictions. See Schedule 1.
d) Access plans
The Bot may offer free access with limited functionality and paid access (credits or subscription plans) with extended functionality, as specified within the Bot at any given time.
§ 02
Age Requirement

Strictly for users aged 18 and over. This service is intended solely for adults. By using the Bot, you declare and warrant that you are at least 18 years old (or the age of majority under the laws of your jurisdiction, if higher).
Use of the Bot by minors is not permitted under any circumstances, including under adult supervision. Access by a minor constitutes a serious violation of this Agreement.
Age verification
We reserve the right to implement age verification mechanisms at any time. Detection of use by a minor will result in:
- Immediate and permanent access block.
- Notification to the relevant authorities where required by law.
- Deletion of all content associated with the account.
§ 03
Mandatory Consent of Persons Depicted

Fundamental rule: You may only process images of persons who have given their explicit, free, informed, and prior consent to have their likeness processed by AI tools that generate adult or otherwise modified content.
a) What consent requires
Consent must be:
- Explicit: the person must have specifically agreed that their images will be processed by this type of AI tool.
- Informed: the person must know what kind of transformation will be applied to their image.
- Free: given without coercion, pressure, or deception.
- Prior: obtained before any processing begins.
- Verifiable: you must be able to demonstrate that consent was obtained if required to do so.
b) Sole exception: images of yourself
The only person for whom you do not need to obtain third-party consent is yourself, when processing images in which you are the sole recognisable subject.
c) User responsibility
We are technically unable to verify the consent of persons appearing in images. Therefore, the full responsibility for obtaining and maintaining that consent rests exclusively with the user. We assume no liability arising from the processing of images without consent.

Processing images of persons without their consent may constitute a criminal offence in many jurisdictions, including non-consensual pornography, defamation, extortion, or harassment. Penalties may include imprisonment and significant fines. Our policy is to cooperate fully with authorities investigating such conduct.
§ 04
Synthetic Nature of AI-Generated Content

All output is artificial. Images produced by the Bot are synthetic creations generated by artificial intelligence. They are not real photographs, they do not represent reality, and they must never be presented or used as if they were authentic.
a) Prohibition on presenting content as real
It is strictly prohibited to:
- Claim, imply, or suggest that generated content is a real or authentic photograph of a person.
- Use generated content to deceive third parties about the appearance, behaviour, or identity of a person.
- Distribute generated content without clearly indicating that it was produced by artificial intelligence.
- Use generated content as evidence, proof, or accusatory material of any kind.
b) Mandatory labelling
If a user chooses to legitimately share generated content (having obtained all necessary consents), it must always be accompanied by a clear and visible notice that it is AI-generated content and not real photographic material.
c) Nature of the output
Generated images are the product of mathematical models trained on synthetic data. Any resemblance to real persons in the output is a statistical coincidence and not a representation of reality.
§ 05
Prohibited Uses
Users are strictly prohibited from using the Bot to:
- Process images of minors, regardless of the type of modification requested.
- Process images of persons without their explicit, free, and informed consent.
- Create, distribute, or store child sexual abuse material (CSAM) or any content that victimises minors.
- Generate non-consensual intimate imagery (NCII).
- Harass, extort, blackmail, defame, or damage the reputation of any person using generated content.
- Create deepfakes or false content for the purposes of disinformation, political manipulation, or fraud.
- Distribute generated content without disclosing its synthetic nature.
- Carry out unauthorised access, attacks, or technical interference against the Bot or its systems.
- Attempt to extract, scrape, or exfiltrate data belonging to other Bot users.
- Circumvent or bypass the Bot's automated moderation measures.
- Use the Bot for commercial purposes without express written authorisation.
- Engage in any activity contrary to the laws applicable in your jurisdiction.

Active prosecution: Any detected prohibited use will be reported immediately to the relevant authorities. We reserve the right to pursue civil and criminal legal action against offenders. We cooperate proactively with Interpol, Europol, the NCMEC, and national and international law enforcement agencies.
§ 06
User Responsibility
The user is solely responsible for:
- All images uploaded to the Bot and any use made of them.
- Having obtained the legal consent of all persons depicted in input images.
- Compliance with the legislation applicable in their country or jurisdiction regarding the use of generative AI tools and the handling of third-party images.
- Correctly presenting generated content as synthetic material and not inducing error as to its authenticity.
- Safekeeping of images downloaded from the Bot and any subsequent use thereof.
The user agrees to indemnify and hold harmless Magic AI Video, its employees, representatives, and collaborators against any claim, damage, sanction, or legal expense arising from misuse of the Services.
§ 07
Privacy & Data Handling
The handling of data within this service is governed by our Privacy Policy. The operational summary is:

We only process the anonymous Telegram ID, required to manage the active session.

Images are processed in memory for seconds and automatically deleted upon completion.

We do not store images, videos, conversation history, or identifiable personal data.

We do not share data with third parties except strictly necessary technical processors, under confidentiality agreements.

We do not use user content to train AI models.
§ 08
Intellectual Property
a) Our intellectual property
The code, algorithms, AI models, brand, trade name, and all technical infrastructure of the Bot are the exclusive property of Magic AI Video or its licensors, and are protected by applicable intellectual property laws.
b) Generated content
Images generated by the Bot from user instructions are for the user's personal use, within the limits set by this Agreement. We do not claim ownership over generated output.
c) User-uploaded content
Images uploaded to the Bot remain the property of the user or their rightful owners. The user grants the Bot a temporary technical licence, strictly limited to the processing necessary to provide the Service, which expires automatically at the end of the session.
§ 09
Payments & Refunds
a) Payment methods
Credits and payment plans may be purchased by debit/credit card or crypto assets, according to the options available in the Bot at any given time. Payments are processed by external payment processors; we do not have access to your card details.
b) Refunds
Refunds are governed by the following conditions:
- Requests must be submitted within 14 calendar days of the purchase date.
- Requests must be made via support, stating the reason, order number, and purchase date.
- The refunded amount may be proportional to the use already made of the purchased credits or plan.
- No refunds will be issued for prohibited use or breach of this Agreement.
§ 10
Moderation & Sanctions
a) Automated and manual moderation
The Bot employs automated systems to detect prohibited content. We also conduct periodic manual reviews to ensure compliance with this Agreement.
b) Sanction scale
Upon detecting violations, we may apply the following measures gradually or directly, depending on severity:
- Formal warning.
- Temporary access restriction.
- Permanent Telegram ID block.
- Report to competent authorities.
- Civil and/or criminal legal action.
c) Abuse reporting
Any user may report abusive use or inappropriate content via the support email. We respond to all reports within a maximum of 72 hours.
§ 11
Law Enforcement Cooperation
We reserve the right, and where applicable have the obligation, to disclose information to police, prosecutorial, or judicial authorities when required by applicable law or a valid court order.
In particular, we will actively cooperate with authorities investigating cases related to:
- Child sexual exploitation or CSAM material.
- Creation and distribution of NCII (non-consensual intimate images).
- Extortion, blackmail, or harassment perpetrated using generated content.
- Any other criminal offence in which the Bot has been used as a tool.
We will notify the affected user of such disclosures wherever permitted by law and where doing so does not compromise an ongoing investigation.
§ 12
Limitation of Liability
The service is provided on an "as-is" and "as-available" basis. We do not warrant uninterrupted operation of the Bot or the absence of errors.
In no event shall Magic AI Video be liable for indirect, special, incidental, or consequential damages arising from use of the Bot. Our maximum aggregate liability for any claim shall not exceed the amount paid by the user in the 30 days preceding the event giving rise to the claim.
We expressly disclaim all liability for misuse by the user of generated content, including its non-consensual distribution, its presentation as authentic material, or its use in illegal activities.
§ 13
Governing Law & Dispute Resolution
a) Governing law
This Agreement is governed by the laws of the British Virgin Islands. Users residing in the EU or UK additionally benefit from the mandatory consumer protection provisions of their national legislation.
b) Amicable resolution
Any dispute must first be attempted to be resolved amicably within 30 calendar days of formal written notification of the conflict.
c) Jurisdiction
Should no agreement be reached, exclusive jurisdiction lies with the courts of the British Virgin Islands, without prejudice to the right of EU or UK consumers to bring proceedings before the courts of their domicile.
§ 14
Modifications & Termination
This Agreement enters into force from the first use of the Bot and remains in effect until terminated by either party. We may modify it unilaterally at any time; changes will be published in the Bot and/or the official channel. You may terminate the Agreement by ceasing to use the Bot.
We may suspend or cancel any user's access at any time, particularly in the event of a breach of this Agreement or a legal requirement to do so.
